At Matteo Gilfillan & Associates Inc., we offer a wide range of fire and life safety consulting services relative to both new construction and existing buildings in a multitude of markets and in varying degrees of complexity.  We work with developers, architects, engineers, private owners / operators, government agencies, and local authorities and utilize our proven approach to Code consulting to build long-term relationships.

Our project experience ranges from small housing / townhouse developments, to multi-tower mixed use high rise complexes, retail malls, arenas, and hospitals.

Building Code Consulting

  • Providing Code compliance guidance on architectural, mechanical, electrical, and interior design drawings for a project will benefit the design team in mitigating significant design changes in the later stages of a project and encouraging efficiency and coordination in the design development process. Code compliance guidance will also benefit interactions with the authorities, by promoting a clear understanding of the Building Code approach for the permit submission, thus resulting in fewer comments pertaining to the submission and a more expedient turnaround for the building permit.

    In addition, reviewing early iterations of the project design drawings assists with keeping the project direction on track from the onset and providing confidence for proceeding with other aspects of the project (e.g., sales, marketing, etc.).

    Our firm will review the architectural drawings with respect to the life safety and fire protection requirements of the Building Code, and prepare documentation, in the form of a Design Brief and/or drawing mark-ups, identifying any Building Code issues or other methods for improved, cost-effective fire and life safety design.

  • A Compliance Report provides owners and authorities alike with information regarding a project’s fundamental construction, occupancy classification requirements and specific status with respect to compliance with critical fire and life safety requirements in the Building and/or Fire Code (as applicable). Compliance Reports are typically required by the authorities to comprise a complete Building Permit application submission.

    MGA will prepare a Building Code (or Fire Code, subject to the needs of the project) Compliance report for submission as part of the Building Permit application. In addition, the Compliance report can be used to provide consistent and coordinated direction to the design team.

  • The provision of life safety diagrams will further expedite a plans examiner’s review of Building Permit drawings, in addition to providing a Code Compliance report. Life safety diagrams will depict such Code items as exit locations, travel distances, fire separations and associated fire-ratings, occupant loads, exit capacities, spatial separation requirements, and even water closet calculations.

    MGA will prepare life safety diagrams for submission as part of the Building Permit application for your project. The drawings will be created on a per floor basis (as required) and will illustratively identify compliance with select Building and Fire Code requirements.

  • There are instances where, whether due to innovation, material / system choice, or potential cost savings, a particular design or approach to an issue by the project’s design team will not satisfy the ‘acceptable solution’ requirements of the Building or Fire Codes. In these instances, the Codes permit the use of alternative solutions to meet the minimum level of life safety envisioned by the Codes when these alternative solutions can be proven to provide an equal or higher degree of life and fire safety.

    MGA will assist in creating an alternative solution to the proposed prescriptive variance based on the Objectives and Functional Statements associated with the applicable Code requirements. Our firm will also prepare Alternative Solution Proposal (ASP) documentation and supporting information for submission to the authorities to demonstrate the Code required performance level of a proposed alternative solution relating to fire and life safety.

  • The Building Code Commission (BCC) acts as a judicial body, as authorized under the Building Code Act, whose purpose is to resolve project specific disputes regarding sufficiency of compliance with the requirements of the Ontario Building Code. In effect, the BCC is a mechanism in Ontario through which to appeal decisions by the Authority Having Jurisdiction pertaining to interpretation of the technical requirements in the Building Code.

    MGA will review the position under dispute, prepare and coordinate the BCC Application documentation, including supporting technical documentation, and provide client representation at the Building Code Commission hearing.

  • The Building Code outlines the minimum mandatory level of built environment design requirements related to barrier-free accessibility throughout a building, with the intent to capture the principles of dignity, flexibility, accommodation, functionality, and integration. In recent years, the Building Code requirements for barrier-free design have become more robust and detailed.

    MGA will review designs and layouts for compliance with the built environment accessibility requirements in the Building Code, taking into consideration Human Rights and equivalent access perspectives. MGA will also produce a report summarizing any noted deficiencies and potential cost-effective solutions.

  • Rick Hansen Foundation Accessibility Certification (RHFAC) is a national rating system that measures and certifies the level of meaningful access of buildings and sites from the perspective of those with mobility, vision, and hearing disabilities, and those that benefit from mind friendly environments, and promotes increased access through Universal Design principles.

    MGA has staff which are designated RHFAC Professionals that have undergone training and are able to conduct RHFAC ratings in the built environment.

Fire code consulting

  • The purpose of a Fire Code audit is to identify items requiring action to meet the minimum fire and life safety requirements in the Fire Code, for which the owner of an existing building is responsible. These audits may form part of a larger Property or Building Condition Assessment (PCA / BCA) prepared for the purposes of due diligence, pre-lease / pre-purchase, building renovation, or re-mortgage.

    MGA will conduct Fire Code audits to review and identify components of an existing building that are required to be upgraded or repaired in order to maintain the minimum level of safety as established by the provisions of the Fire Code. Items to be reviewed include fire separations, means of egress, fire alarm and fire suppression systems.

  • In Ontario, existing buildings of specific occupancies (namely assembly, residential, healthcare, and hotel) are required to undergo a Retrofit Audit to establish required upgrading for achieving a minimum level of life safety through containment, means of egress, suppression and detection methods. Although the Ontario Fire Code retrofit requirements have existed for over 30 years, there are many facilities for which a Retrofit Audit has yet to be conducted. The Ontario Fire Code places the responsibility for conforming to the retrofit requirements squarely on the owners of a building. In addition to the legal mandate to comply with retrofit requirements, failure to complete any necessary retrofitting may have an impact on insurance and mortgage matters related to the facility.

    MGA will conduct a comprehensive visual, non-destructive audit of the building and provide documentation outlining any noted retrofit deficiencies as well as cost effective compliance solutions. In the event that compliance with a prescriptive retrofit requirement of the Ontario Fire Code is not feasible, MGA will review alternative methods / concepts and prepare a Life Safety Study that will describe how the intent of the prescriptive retrofit requirement can be achieved.

  • An inspection of your building / facility by the local Fire Services (as permitted under the Fire Protection and Prevention Act (FPPA) may unearth Fire Code violations requiring rectification by the building owner. These Fire Code infractions are typically reported in a Notice of Violation or an Inspection Order.

    MGA assists by reviewing the violations outlined in the Notice of Violation / Inspection Order against the as-built conditions of the facility and by providing solutions to the items raised. MGA will also assist with authority discussions regarding the proposed resolutions, including concept discussions, and the schedule of implementation and rectification of the issue.

  • Fire Safety Plans (FSPs) are documents that provide direction and guidance for the safe evacuation of occupants, actions to be taken by supervisory staff, and requirements for maintaining fire protection and life safety systems serving the facility. Fire Safety Plans are mandated for certain occupancies or based on certain facility characteristics (ranging from townhouses to high hazard industrial buildings and high rise complexes) under Section 2.8 of the Fire Codes and are to be implemented at or before occupancy.

    In cooperation with your local Fire Services, MGA will develop a Fire Safety Plan for your facility, outlining building resources, responsible (supervisory) personnel, their roles and responsibilities, evacuation procedures, maintenance requirements, fire drill procedures, fire prevention measures, and alternative safety measures. In addition, MGA will create schematic floor and site plan diagrams illustrating exit locations and select fire and life safety system device locations. The completed document will be submitted to the local Fire Services for review and approval.

    MGA will also assist with the creation of training programs and presentations geared towards owners and operators, supervisory personnel, and occupants. This training material can be fashioned to be a high level overview of the Plan in its entirety, or tailored to address the content of your Fire Safety Plan specific to a given supervisory personnel and their roles and responsibilities.

  • The Fire Code requires that a Fire Safety Plan be rehearsed at regularly scheduled intervals (as dictated by the Fire Code based on the building characteristics) to ensure proper implementation of the building’s approved Plan. A fire drill is used to reenact and practice the Plan’s emergency evacuation procedures and the roles and responsibilities of supervisory personnel.

    MGA will provide guidance and prepare training material on how to conduct and record a fire drill for your facility. If desired, MGA will also observe a fire drill to evaluate the drill and provide feedback on areas requiring improvement.

  • Evacuation diagrams provide visual information that will present clear and efficient direction to occupants in the event of an emergency evacuation scenario. The diagrams – which can also be referred to as ‘YOU ARE HERE’ drawings – are a pictorial representation of the building floor plans consisting of evacuation and life safety system information relevant to building occupants.

    MGA will prepare and assist with the location and positioning of evacuation diagrams for your facility.

  • The Fire Code requires that your building’s Fire Safety Plan be reviewed on an annual basis to ensure that the information within the plan is up-to-date and that implementation is being carried out. In addition, the Fire Code contains maintenance requirements for the built environment and fire protection systems.

    MGA will prepare an Annual Review program catered to your facility’s needs. This program may include a review of the Fire Safety Plan for verification that the information is current, a review of fire drill records, a review of maintenance logs, and a high level Fire Code audit of the building’s common areas relative to occupant life safety and fire protection system maintenance.

  • The Building and Fire Codes offer a benchmark for a minimum level of life safety; however, the requirements of the Codes can be subject to interpretation, which can lead to items of discussion or dispute with the authorities. For this reason, it is imperative that the intended Code approach be clearly communicated to the authorities prior to, or in conjunction with, the Building Permit application process. We recommend that the project plans be reviewed ahead of the building permit drawing set and that a Code Compliance report and associated life safety diagrams be prepared as part of the Building Permit submission.

    However, if items of dispute or issues requiring further discussion or clarification arise, MGA will negotiate with building and fire officials to reconcile any differences in interpretation and work towards an agreeable solution for all parties. If necessary, MGA will also assist with preparing Alternative Solutions or Building Code Commission documentation to address project disputes.

  • For legal cases arising from the Building Code Acts and Fire Protection & Prevention and regulations, MGA can provide consulting to legal firms and to municipalities, as an expert on fire and life safety Code matters as well as expert testimony. Our legal consulting services can also provide assistance and direction in dispute resolutions.

  • For the purposes of addressing innovative construction practices, introducing and regulating new products and Code approaches, harmonizing National and Provincial Codes, and enhancing the quality and performance of the prescriptive requirements, the Building and Fire Codes undergo cycles during which potential changes to the prescriptive Code requirements are reviewed and considered for implementation.

    MGA plays an active role in the Code development process through contributing feedback in the Proposed Code Changes public consultation process; as well as participating as a stakeholder on various Code Committees and Task Groups.

    MGA will also assist our clients in preparing and submitting Code Changes, should they desire to modify or revise a Code requirement or introduce new regulations. This process involves researching the proposed Code changes and their root Code requirements, preparing documentation in support of the proposed change, attending stakeholder meetings to discuss the proposed changes, completing the Code Change submission forms on the client’s behalf, and representing our client at Technical Advisory Committee meetings.

  • MGA will provide presentations and seminars in matters of fire and life safety, impending Codes and Standards changes, and barrier-free accessibility to owners, staff, architects, engineers, developers, authorities, and industry organizations and associations.

    Presentation topics can be broad or specific, depending on the needs of the client, and range from 1 hour to multi day events.

  • A Capital Replacement / Reserve Fund Study is a requirement for every residential, commercial, and industrial Condominium Corporation in the Province of Ontario. This study will contain immediate and anticipated capital repair costs; as well as, replacement and services costs budgeting over the life of the building.

    Similarly, every new condominium in Ontario requires a Performance Audit before its first year is complete, to review for design deficiencies relative to the common elements of the building with respect to the Building Code of record. A Performance Audit will typically also include a review of a representative sample of units.

    MGA will assist owners and investors in evaluating properties by creating Capital Replacement / Reserve Fund Studies and Performance Audits, as applicable, with respect to fire and life safety Code requirements. This study will include assessing the condition of existing fire protection and life safety systems for your building, and preparing a cost estimate breakdown for anticipated repairs for budgeting purposes.

  • Though security is not explicitly addressed in the Building Code, certain requirements of the Building Code have an impact on which security measures can be applied in certain scenarios and configurations.

    MGA will review the proposed security plans for the project with respect to the Code permissions and limitations relative to the proposed security hardware (e.g., electromagnetic locking devices, electric strikes, key locks) and will work with the design team to establish Code compatible solutions to address security concerns.

  • Since 2020, the Ontario Building Code requires construction projects to undergo testing to the standards of the CAN/ULC S1001, “Integrated Systems Testing of Fire Protection and Life Safety Systems”, in order to verify that systems are properly integrated. These standards apply to any and all combinations of two or more fire protection and life safety systems that are designed to operate together. Subsequent periodic testing of integrated systems is further required 1 year after the initial testing, and in intervals of 5 years thereafter.

    In cooperation with your design team, MGA will coordinate fire and life safety system integration testing and completion of the Integrated Testing Plan (ITP) in accordance with CAN/ULC-S1001, as required by Division B, Part 3, Sentence 3.2.10.1.(1) of the Ontario Building Code. All system integrations identified in coordination with the design team will be logged and evaluated as part of the testing coordination process. The process includes physical systems testing that will be attended / witnessed by MGA, the coordination of documentation for each fire protection and life safety system incorporated into the design of the building, and the preparation and submission of the Integrated Systems Testing Report to the appropriate municipal building and / or fire department.
